MYFOOD TERMS OF USE & SERVICE (CUSTOMERS – UNITED ARAB EMIRATES VERSION)

1. INTRODUCTION

These Terms of Use (“Terms”) constitute a legally binding agreement between you (“User”, “Customer”, “you”, “your”) and MyFood FZ-LLC, a company registered and operating under the laws of the United Arab Emirates (“UAE”), with its principal place of business in the Emirate of Dubai (“MyFood”, “we”, “us”, “our”).

By accessing or using the MyFood mobile application, website, or any associated platforms (collectively, the “Platform”), you acknowledge that you have read, understood, and agreed to be bound by these Terms, as well as our Privacy Policy and any additional terms and policies that may apply.

If you do not agree to these Terms, you must immediately discontinue use of the Platform.


2. DEFINITIONS

For the purpose of this Agreement:

  • “Platform” refers to the MyFood website, mobile application, and any digital interfaces that enable Customers to browse, order, and purchase food and related services.

  • “Restaurant Partner” means any independent restaurant, caterer, or food provider listed on the Platform.

  • “Delivery Partner” means any independent third-party company or individual providing delivery services on behalf of the Restaurant Partner.

  • “Order” means a food or beverage order placed by the Customer through the Platform.

  • “Customer” means any person who accesses, browses, or uses the Platform to order food or related services.

  • “Third-Party Provider” includes any courier, logistics company, payment processor, or external entity engaged to provide part of the service.

  • “Halal/ Kosher Certification” refers to documentation provided by the Restaurant Partner ensuring compliance with religious food standards. MyFood does not issue or verify these certificates.

  • “Force Majeure Event” means any event beyond MyFood’s reasonable control, including but not limited to acts of God, government orders, strikes, war, natural disasters, pandemics, or technical failures.


3. ELIGIBILITY

The Platform is available only to individuals aged 18 years or older, who are legally capable of entering into binding contracts under UAE law.
By using the Platform, you represent and warrant that you meet these eligibility requirements.


4. ROLE OF MYFOOD

MyFood acts solely as a facilitator and technology provider.
We connect Customers with Restaurant Partners and independent Delivery Partners.
MyFood:

  • does not own, prepare, handle, or deliver any food;

  • is not a restaurant, caterer, or delivery company;

  • does not verify the quality, safety, ingredients, or kosher status of any food listed on the Platform;

  • is not liable for any action, omission, or negligence of Restaurant Partners or Delivery Partners.

All food and beverages are prepared, packaged, and delivered under the exclusive responsibility of the Restaurant Partner and/or their chosen Delivery Partner.


5. ACCOUNT CREATION

To access and use the Platform, you must create an account (“Account”) by providing accurate, complete, and current information, including your name, email address, phone number, and payment details.
You agree to:

  • Maintain the confidentiality of your login credentials.

  • Accept full responsibility for all activities under your Account.

  • Notify MyFood immediately of any unauthorized access or suspected breach of security.

MyFood reserves the right to suspend or terminate any Account without notice for violations of these Terms or applicable law.


6. ORDER PROCESS

  1. When you place an Order via the Platform, you are submitting a request to the Restaurant Partner.

  2. The Order is not confirmed until the Restaurant Partner accepts it.

  3. MyFood may facilitate payment processing on behalf of the Restaurant Partner but does not control food preparation, packaging, or delivery.

  4. Once accepted, Orders cannot be canceled or modified, except where permitted by the Restaurant Partner or required by law.

  5. Delivery times are estimates only and not guaranteed.

  6. MyFood reserves the right to cancel any Order at any time for operational or safety reasons, including unavailability of menu items, restaurant closure, or delivery constraints.


7. DELIVERY & PICKUP

  • MyFood supports Pickup (collection directly from the restaurant) and Delivery (through independent third-party couriers).

  • Delivery times and coverage areas depend on Restaurant Partner and Delivery Partner availability.

  • MyFood is not responsible for delays, failed deliveries, or incorrect addresses provided by the Customer.

  • Once an Order has been marked “Delivered” in the Platform, MyFood shall not be held liable for any claim of non-receipt.

  • For Pickup orders, Customers must collect their items within the specified timeframe. Uncollected orders may be discarded without refund.


8. FOOD SAFETY, ALLERGIES, AND HEALTH DISCLAIMERS

⚠️ CRITICAL HEALTH NOTICE
MyFood does not manufacture, prepare, or control any food.
All dishes are prepared and handled solely by the Restaurant Partner.

You acknowledge and agree that:

  1. MyFood cannot guarantee that any item is free from allergens (including nuts, gluten, soy, shellfish, dairy, etc.).

  2. The Customer bears full responsibility for confirming ingredients directly with the Restaurant Partner before placing an order.

  3. MyFood provides ingredient information as supplied by the restaurants, without independent verification.

  4. If you have any allergies, medical conditions, or dietary restrictions, you must contact the restaurant directly to confirm the suitability of the meal.

  5. MyFood, its affiliates, employees, and partners shall not be held liable for any allergic reaction, medical consequence, or death arising from consumption of any food ordered through the Platform.

By using MyFood, you irrevocably waive any claim against MyFood relating to food safety, contamination, or health effects.
